篮球仲裁庭是国际篮联认可的独立机构,其从设计到实际运作中致力于通过仲裁简单、快速地解决球员、代理人、教练和俱乐部之间的纠纷。篮球仲裁庭的运行机制与仲裁规则,为篮球领域的纠纷当事方提供了解决纠纷高效、便利的方式。国际篮联仲裁程序机制上的创新性,使得其在实际运行中较为成功,在符合公开标准基础上的详细裁决书,有助于增强其透明度、公信力及可预测性。篮球仲裁庭在处理关于球员合同的效力、提起仲裁请求的时效、保障性合同等常见纠纷上,有其适用原则的独特性。新仲裁规则为仲裁员设立的内部协商机制,及对裁决的审查能够有效促进仲裁庭判例的一致性。篮球运动作为体育运动领域的重要组成部分,其良性发展需要完善的仲裁制度与高效的仲裁机构予以保障。与中国篮协相关的纠纷,能否得到高效、便捷地解决,是篮球运动产业健康、快速发展的重要保障。国际篮联的篮球仲裁庭在机制和运行上的成功,对中国篮协的纠纷解决机制也有着一定的借鉴作用。
The Basketball Arbitration Tribunal is an independent organization recognized by the FIBA,which is committed to the simple and expeditious resolution of disputes between players,agents,coaches and clubs through arbitration from design to actual operation.The operation mechanism and arbitration rules of Basketball Arbitration Tribunal provide an efficient and convenient way to resolve disputes for parties to disputes in the field of basketball.The innovation of the Basketball Arbitration Tribunal arbitration process mechanism makes it more successful in practical operation,and the detailed award on the basis of compliance with the open standards can help to enhance its transparency,credibility and predictability.In dealing with the effect of the contract of the players,the Basketball Arbitration Tribunal has the uniqueness of the application principle in the common disputes,such as the effect of the contract of the players,the limitation of the request for arbitration and the guaranteed contract.The new arbitration rules provide for the internal consultation mechanism established by the arbitrators,and the review of the award can effectively promote the consistency of the jurisprudence of the Basketball Arbitration Tribunal.As an important part of sports field,the benign development of basketball needs to be guaranteed by perfect arbitration system and efficient arbitration institutions.Whether the dispute related to the China Basketball Association can be solved efficiently and conveniently is an important guarantee for the healthy and rapid development of the basketball sports industry.The success of the Basketball Arbitration Tribunal in the mechanism and operation also has a certain reference to the dispute settlement mechanism of the Chinese Basketball Association.
