摘要
我国《行政处罚法》第37条第2款规定的证据先行登记保存在实际执法中存在诸多法治问题,不利于目前的城管执法工作。主要表现为:先行登记保存的实施程序违背法律规定,对其实施和设立都缺乏相应的监督等。这些问题的核心归结于城管部门缺乏强制权,只能使用先行登记保存来固定证据。因此,在现行法律未能修改的情况下,利用地方性法规赋予城管执法部门一定的行政强制权,是解决先行登记保存制度弊端的良好途径之一。
There are many issues in the practice of registration and preservation of evidence according to the second paragraph of Article 37 of the administrative penalty law of China,which is not conducive to the current law enforcement work of urban management.The main performance of the application is that the implementation procedure of the first registration and preservation violates the law,and lacks the corresponding supervision of its implementation and establishment.The core of these problems is due to the lack of compulsory power of the urban management department,which can only use the first registration and preservation to fix the evidence.Therefore,in the case that the current law cannot be amended,it is one of the good ways to solve the malpractice of the system of first registration and preservation by using local laws and regulations to endow urban management and law enforcement departments with certain administrative coercive power.
