摘要
《关于促进护理服务业改革与发展的指导意见》明确提出要“大力发展护理产业。”在全面依法治国的今天,实现护理产业大发展,法律不能缺位。文章通过文献及政策梳理,从而得到如下几方面建议:制定《护理产业促进法(条例)》在性质上应为主干法,具有综合法属性;在要求上,应根植于我国护理产业实际,尊重护理产业发展一般要求和法的自身运行规律;在体例上,应包含总则、研发支持、人才保障、经营扶持、金融保障、监督检查及法律责任和附则等7个部分;在内容上,应以护理产业的人才培养培育、财税金融保障和产业管理制度为核心。
Guidance on Promoting the Reform and Development of Nursing Service Industry clearly proposes to vigorously develop the nursing industry.In the context of fully advancing law-based governance,the law plays an irreplaceable role in the development of nursing industry.Through massive literature review and policy analysis,the authors proposed the following suggestions:the Nursing Industry Promotion Law(Regulations)should be formulated as a basic and comprehensive law.In terms of requirements,it should be rooted in the reality of China’s nursing industry,adhere to the general requirements of the nursing industry and the law operating rules.In terms of framework,it should cover 7 parts,including general rules,research and development support,talent guarantee,business support,financial guarantee,supervision and inspection,legal responsibilities and annex.In terms of content,it should focus on talent cultivation,financial and taxation support and industrial management systems.
