摘要
监察制度的健全与完善要特别重视顶层设计,确定准确的指导思路。国家的监察机关与党的纪律检查机关在监察制度体系中要兼容配合。统一的国家监察立法要求在制定国家监察法的同时,整合相同功能的法律法规规章和规范性文件并关注其衔接协调。要从提高法律地位、扩大职责权限、增强与党纪检查的协同等方面构建高效的国家监察机构。应当加强对监察机关及其公务人员行使职权时的监督,遵循宪法和刑事诉讼法的控制,形成事前预防、事中约束、事后追责的权力制约的科学机制。
The improvement of the supervision system should pay special attention to the top-level design and pick accurate guiding ideas.The supervisory organ and the Party's disciplinary inspection organ should be compatible.Besides Supervision Law,the unified supervision legislation requires that laws,regulations and regulatory documents with the same functions are supposed to be integrated,and attention is paid to their convergence.It is necessary to build an efficient national supervisory institution in terms of improving legal status,expanding responsibilities and powers and enhancing coordination with the Party discipline inspection.Strengthening the supervision of the supervisory authorities and public servants in exercising their powers,and following the constraints of the Constitution and the Criminal Procedure Law are ways to form a scientific mechanism of power restriction with the characteristics of prevention in advance,restraint during the event,and accountability after the event.
