摘要
经济法基本原则证立的非教义学化,是经济法基本原则不明确、不统一的重要原因。经济法研究的法教义学转向,为经济法基本原则的法教义学证立,为实现其明确、统一提供了可能。从法教义学出发,在探寻现行经济法秩序的基础上,经济法基本原则应包括经济自由原则、社会本位原则、经济法治原则和比例原则。
The ambiguity and disunity of the fundamental principles of economic law is crucially resulted from the non-dogmatics of their establishment.The shift of the economic law research into legal dogmatics provides the possibility of making the fundamental principles of economic law clear and unified.Depart from legal dogmatics,base on the exploration of the current order of economic law,the paper contends that the fundamental principles of economic law shall incorporate the principles of economic freedom,society standard,economic rule of law and proportionality.
