摘要
行政举报奖励制度是鼓励公众参与社会治理的重要措施。职业举报行为的出现造成了行政执法资源的严重浪费,未能实现制度的设计初衷,这是由职业举报人的运作模式、各方制度认知的差异、法律依据的"过责不适应"以及规定中"酬大于劳"等因素失范导致的。学理上应明确行政举报奖励制度中行政机关和举报人之间形成"悬赏合同"关系,以使行政举报奖励制度切实发挥作用。
The reward system of administrative report is an important measure to encourage the public to participate in social governance.The emergence of professional reporting has caused a serious waste of administrative law enforcement resources and failed to realize the original intention of the system design.This is caused by the operational mode of professional whistleblowers,the cognitive differences of various systems,the"over responsibility and maladjustment"of legal basis,and the"pay more than work"in the regulations.In theory,we should make clear the relationship between the administrative organ and the informant in the reward system of administrative report,so as to make the reward system of administrative report work effectively.
