摘要
固定源环境管理制度改革中排污许可取代环评成为了新的核心制度,由此产生了制度衔接的需求。当前,我国采取了多阶段行政行为构造,将环评和排污许可设定为两项独立的、具有先后关系的行政许可。这种制度设计存在重复评价的问题,也使行政相对人产生了额外的、不必要的负担。在生态文明体制改革与行政审批改革两大背景下,环评与排污许可制度的衔接应当以环境价值与效率价值的平衡为取向。在保留环评要求的基础上,取消固定源的环评审批,实现环评与排污许可制度的整合,应当是未来我国固定源环境管理制度改革的基本方向。
In the reform of the fixed source environmental management system,the emission permit has replaced the EIA as the core system,resulting in the need for system integration.In China EIA and emission permit are two independent,successive administrative permits,which is a multi-stage permit structure.This system design has led to repeated evaluations for administrative counterparts,and has also imposed unnecessary burdens on administrative counterparts.Under the backgrounds of the reform of the ecological civilization system and the reform of administrative approval,the link between EIA and emission permits needs to be based on the balance of environmental value and efficiency value.The direction of the reform of fixed source environmental management system should be retaining the requirements of EIA,but cancellation the EIA approval,and incorporating the of EIA approval into emission permit.
