摘要
黑社会性质组织的“本质特征”基于其独特的识别、界分作用具有重要意义。应当在坚持特征系统论说的基础上,以非法控制特征为核心,构建黑社会性质组织的特征体系。作为本质特征的非法控制特征具有“非法性”与“控制状态”两个层面。“非法保护”“公开性”不是非法控制特征的必要要件。“非法性”主要有暴力手段上的非法性和控制状态的非法性两个内容;“控制状态”的“一定行业”应当包括非法行业且不必然具有排他性。“非法性”的认定可借助并发犯罪的认定得以实现,“控制状态”的认定需要借助证人证言在数量上的优势以填补言辞证据证明力的不足。对黑社会性质组织犯罪的认定应当坚持对非法控制特征的把握,否则容易走向“唯现象论”。
In the background that the special operation called“the crushing of Mafia-like and criminal forces”is increasingly marginalized and specialized,the“essential characteristics”of underworld-like organizations are of great significance based on their unique function of identification and demarcation.On the basis of adhering to the characteristic-systematic theory,the characteristic system of triad organizations should be built with the characteristics of illegal control as the core.The illegal control feature as an essential feature has two levels:“illegal”and“control state”.“Illegal protection”and“openness”are not necessary for illegal control features.“Illegal”mainly includes the illegality of violent means and the illegality of the control state;the“certain industry”of the“control state”should include the illegal industry and without certain exclusiveness.The determination of“illegality”can be achieved by the determination of concurrent crimes.The determination of“control status”needs to rely on the quantitative advantages of witness testimony to fill the lack of verbal proof.The identification of underworld-like organizations should insist on grasping the characteristics of illegal control,otherwise it is easy to move towards“phenomenology”.
