摘要
住房反向抵押作为老年人利用自有住房实现个人养老保障的一种特殊担保方式,因其制度的构造有异于传统物权而引发关注。当下中央层面全面推出老年人住房反向抵押养老保险,然而效果不佳、举步维艰。唯有选择性地借鉴域外成功经验,突破制度障碍和技术障碍,赋予住房反向抵押权利的合法性并予以规制。虑及与本土法治资源相融合,当作为一种特殊的抵押权,适用《民法典》物权编担保物权中抵押权制度规则,并以不动产登记保障相关权利人。
Reverse mortgage as a special guarantee method for the elderly to achieve personal pension protection with their own houses,has already attracted attention because of the institutional structure different from traditional property rights. At present,the central government has comprehensively launched the reverse mortgage insurance for the elderly,but the effect is not good and the pace is difficult. Only by selectively learning from foreign successful experiences,breaking through institutional barriers and technical obstacles,can the legality and regulation of reverse mortgage rights be granted.Considering the integration with domestic law,it should be based on the mortgage system. As a special kind of mortgage right,the reverse mortgage should be governed by the rules of the mortgage system in the real right of the " Civil Code" property rights,and the real estate registration should protect the relevant right holders.
