摘要
基于生态文明与信息文明并存发展的时代背景,环境信息管理到环境信息治理思想的转变意味着我国环境保护与治理创新工程需要打造信息共建、信息共治、信息共享三目标相互吻合的环境信息治理格局。目前我国以管理者一元主导的"旧三角"环境信息法权结构已经不能适应生态文明信息化时代发展的需求。在对当前环境信息法权结构之基本样态和结构性困境进行解构辨识的基础上,提出重塑"三角中柱互动运行法权结构"即"三角法权结构绕中柱功能互动运行之环境信息法权结构"命题具有重大意义。就重塑的基本原则而言,应重点遵循有限权利原则、分权与制衡原则和权利自治原则;就重塑的具体路径而言,可从厘清管理者的权力边界、搭建一体化的环境信息交流平台、强化环境信息权利对权力的监督与制约、实现公众环境信息权的法律再造等核心方面共同推进。"新三角"环境信息法权的结构重塑,将推动生态文明信息化时代的环境信息法治建设工程向共建共治共享的目标迈进。
The era of coexistence and development of ecological civilization and information civilization. The change from environmental information management to environmental information governance means that China’s environmental protection and governance innovation projects need to create an environment information governance pattern of co-building,co-governance and sharing. At present,China’s " old triangle" environmental information legal power structure dominated by managers has been unable to meet the needs of the development of the era of ecological civilization information. Based on the deconstruction and identification of the current state of the legal structure of environmental information and the structural dilemma,it is proposed to reshape the " triangular central column interactive operation legal structure",that is,the " triangular legal structure interactive operation around the central column function the proposition of " Environmental Information Legal Structure" has important value significance. As far as the basic principles of remodeling are concerned,the principle of limited power,the principle of decentralization and checks and balances,and the principle of autonomy of rights should be emphasized. As for the specific path of remodeling,it is possible to clarify the power boundaries of managers and build an integrated The core aspects of the environmental information exchange platform,strengthening the supervision and restriction of environmental information rights on power,and the legal reconstruction of public environmental information rights are jointly promoted. The restructuring of the " new triangle" environmental information legal power structure will make the environmental information legal construction project in the era of ecological civilization informatization move towards the goal of co-construction,co-governance and sharing.
