摘要
在数字化转型过程中,必然面临的重要问题之一即是如何提高人们的数字信心,而这一问题必然离不开法治因素的参与,《比利时数字法案》就是该国应对上述问题的一次尝试。以内容分析法和文本分析法为主要研究方法,以从比利时经济部官网获得的法律政策、技术办法和执行指南等作为主要数据来源,发现《比利时数字法案》表现出了重视法律效力的可落地、提高服务市场的规范性、推动应用场景的全覆盖和确保对服务市场的监管等特征。相对于比利时,我国数字化归档工作在数字化环境、法治意识、应用场景和服务市场等方面存在问题。针对上述问题,结合比利时案例,为我国数字归档法治建设带来了如下启示:一是完善数字化归档的法治环境﹔二是优化数字化归档的内控体系﹔三是探索数字化归档的应用场景﹔四是激励数字化归档市场的发展。
In the process of digital transformation,one of the important issues that will inevitably face is to increase people’s digital confidence,and this issue is bound to be influenced by the legal factor.The Belgian Digital Act is an attempt for the country to deal with the above issue.With the methods of content analysis and text analysis,the analysis on the characteristics of the Digital Act were made based on the data of law,policy and business guidance mainly collected from the related official websites.The results show that they think highly of the effectiveness of law,the standardization of the service market,the full coverage of application scenarios,and ensures the supervision of the service market.Compared with Belgium,China’s digital archiving legal system is facing problems from the aspects of digital environment,legal awareness,application scenarios,and service market.In response to the above problems,combined with the Belgian case,the following enlightenments have been brought to the Chinese law construction related to digital archiving:the first is to improve the legal environment of digital archiving;the second is to optimize the internal control system of digital archiving;the third is to explore the application scenarios of digital archiving;the fourth is to stimulate the development of the digital archiving market.
