摘要
公共企事业单位作为《政府信息公开条例》的参照主体,其内部的异质性未能得到充分体现,各类承担公共服务职能的事业单位、企业主体混杂"权力行使"与"提供服务"的特殊性,在适用中既可排除对权力性活动的调整,又可将自主经营活动范围剔除,双向架空之后该条的适用空间极其有限。暴露出的问题是《政府信息公开条例》基于自律逻辑对行政机关的约束无法自然延伸至公共服务相关主体,现有规范对行政机关与公共企事业单位、服务相对人(公众)之间的三角关系缺乏考量,基于强化行政机关监督职能的制度前提,应当区分公共服务经营者的公共性强度、引入强制信息披露作为公开方式,同时架构申请主体与信息公开范围的对应关系。
Public enterprises and institutions,as the reference subject of Regulations of Government Information Disclosure,the internal heterogeneity has not been fully embodied,and the special characteristics of the various institutions and enterprises undertaking public service functions mixed"exercise of power"and"provision of services",in the application of which not only can be excluded from the adjustment of power activities,but also the scope of autonomous business activities can be excluded,so the application of this reference article is extremely limited.The problems exposed are that the Regulation’s constraints on administrative organs based on self-regulatory logic cannot naturally be extended to public service related subjects,the existing norms lack consideration of the triangular relationship between administrative organs and public enterprises and institutions and service providers(the public).Considering the institutional premise of strengthening the oversight function of the executive branch,a distinction should be made between the public nature of public service operators,mandatory information disclosure should be introduced as a means of disclosure,and the correspondence between the subject of the application and the scope of information disclosure should be structured.
