摘要
当前,辱骂警察的违法行为频繁发生,各地公安机关也对此类行为进行了相应处罚,但处罚依据各不相同,甚至出现处罚依据错误的案例。为进一步厘清各类辱骂警察的违法行为之处罚依据,在案例分析和理论论证的基础上,提出以下建议:仅有辱骂行为,没有其他后果的,按照《治安管理处罚法》有关“侮辱”的相关法律规定处罚;辱骂行为妨碍公务的,按照“妨碍公务”的相关法律规定处罚;辱骂行为扰乱公安机关工作秩序的,按照“扰乱工作秩序”的相关法律规定处罚;在网络上无事生非,辱骂警察的,按照“寻衅滋事”的相关法律规定处罚;打电话、发短信辱骂警察,严重影响其工作和生活秩序的,按照“干扰他人正常生活”的相关法律规定处罚等等。
At present,abusing the police is a frequent occurrence,the local public security organs have also imposed corresponding penalties for such behaviors,but the punishment basis which is different,and there are even cases of wrong punishment basis.In order to further clarify the punishment basis for all various types of abusing the police,on the basis of case analysis and theoretical demonstration,and put forward the following suggestions:Firstly,If there are only abusive behaviors and no other consequences,the punishment in accordance with relevant laws and regulations related to"insults"in People's Republic of China Public Security Management Punishment Law.Secondly,If the abusive behaviors have interfered with official duties,the punishment in accordance with relevant laws and regulations related to"interference of official duties".Thirdly,If the abusive behaviors have disturbed the work orders of public security organs,the punishment in accordance with relevant laws and regulations related to"disturbance of work orders".Fourthly,If personnel abusing the police through make trouble on the Internet,the punishment in accordance with relevant laws and regulations related to"make trouble of nothing".Fifthly,If personnel abusing the police through phone calls and text messages,seriously affecting their work routines and live orders,the punishment in accordance with relevant laws and regulations related to"disturb the normal life of others"and so on.
