摘要
近年来我国网络数据造假形势严峻,甚至已成为互联网行业的潜规则,严重危害市场经济发展和社会秩序稳定。数据造假不仅包括我们熟悉的网络刷单,还包括网络平台抄袭和微博、微信刷量买粉等常见行为。探索治理网络数据造假的法律路径,必须从其本体特征入手以解决现实问题为研究目标,考虑增设利用信息网络妨害业务罪,建立合适的行刑过度机制,充分利用法律的治理能力,在保障刑法谦抑性的同时,加强对企业数据造假行为的刑事处罚。为更好配合刑法实施,应高度重视行业自律,尽快明确官方主管单位,加强多元立体治理。
Data fraud has become an unspoken rule in China's Internet industry,which seriously endangers the stability of market economy and social order.It includes not only the familiar cases of online click farming,but also the common behaviors such as network platform plagiarism,and click farming and“buying fans”on WeChat and MicroBlog.In order to explore the legal path to deal with network data fraud,we must start with its ontological characteristics and take solving the practical problems as the research goal.In this regard,it should be considered to add the crime of using information network to hinder the business,set up an appropriately excessive execution mechanism,give full play to the governance capacity of other laws,and strengthen the criminal punishment of enterprises'fraud behaviors while ensuring the necessity of criminal law.In addition,from the point of view of cooperating with the implementation of criminal law,we should also consider how to give play to the practical effect of the industry self-discipline,clarify the official units responsible for the word,and improve the professional capacities of the governing bodies.
