摘要
为进一步规制与研究操纵比赛,通过法学的视角,从职业足球领域切入,重新分析了操纵比赛的认定要件,并提出了全新的操纵比赛的类型划分。运用文献资料法和案例分析法展开研究。研究发现,比赛结果一旦被预先知晓或者比赛进程已经被人为固定,职业体育将失去它赖以为生的一切。对操纵体育运动比赛明确、理性、严谨的认定是对其进行规制与研究的重要基本前提。但是,以往无论是在学术界,还是体育领域内部,对于操纵比赛构成的认知过于笼统与片面,并将更多的注意力放置于对于操纵比赛的惩处标准之中。因此,操纵比赛作为一个超出体育运动范围,进入犯罪集团或有组织犯罪领域的重大体育腐败问题,需要重新确定其认定要件与性质,并根据从操纵比赛中获取的不同利益重新对其进行类型划分。
In order to further regulate and study the match-manipulation,through the perspective of Jurisprudence,from the field of professional football,re-analyzed the identification elements of the match-manipulation,and proposed a new type of categorization of the match-manipulation.The research is carried out by methods of literature review and case analysis.It is found that once the result of the game is known in advance or the course of the game has been artificially fixed,professional football will lose everything it depends on for a living.In fact,not only football,all professional competitive sports will be completely destroyed if they are bound by manipulated competitions.A clear,reasonable and rigorous identification for determining the competitive sports games is an important prerequisite for its regulation and studying.However,neither in the academic world nor in the sports field,there is no clear and comprehensive recognition for the constitution of match-manipulation.Instead,more attention is placed on the punishment criteria for match-manipulation.Therefore,it requires the necessary to re-determine its identification elements,the determination of the nature and re-classify its types according to the different benefits obtained from match-manipulation,which is regarded as the major sports corruption problem over the sports scope and enters the areas of criminal group or organized crime.
