摘要
强制医疗作为特殊的司法审查程序,对案涉各方当事人的权利影响极大。《刑事诉讼法》确立了原则性的立法精神,即精神病人的人身危险性为决定是否给予精神病人强制医疗的重要的主观依据。但司法实践中,由于立法上未对精神病人的人身危险性作出明确可操作的界定,导致法官的裁判标准莫衷一是。因此,对精神病人人身危险性的概念进行明晰、对法官认定人身危险性的自由心证进行规范、对人身危险性评价指标与人身危险性的相关度进行分析是准确把握强制医疗适用标准的前提,而上述概念、指标、相关度的模糊性与模糊综合评价原理有较高的契合度。故运用模糊理论,设置精神病人人身危险性评价指标,并构建模糊综合评价模型进行实证研究,对准确认定精神病人人身危险性的大小提供了一种理论可能性。
As a special judicial review procedure,compulsory medical treatment has a great impact on the rights of all parties involved in the case.The criminal procedure law establishes the spirit of principle legislation,which means the personal danger of mental patients is an important subjective basis of deciding whether to give compulsory mental treatment to them.However,in judicial practice,due to the lack of a clear and operable definition of the personal danger of mental patients in legislation,the judge's judgment standards are not unanimous.Therefore,it is the premise of grasping the applicable standard of compulsory medical treatment to clarify the concept of the personal danger of mental patients,standardize the free evidence of the judge's determination of the personal danger,and analyze the correlation between the personal danger evaluation index and the personal danger.The fuzziness of the above concept,index and correlation degree has a high degree of agreement with the principle of fuzzy comprehensive evaluation Using the fuzzy theory,setting up the personal risk evaluation index of mental patients,and building the fuzzy comprehensive evaluation model for empirical research,provides a theoretical possibility for accurately determining the personal risk of mental patients.
