摘要
在应对新冠肺炎疫情等公共突发事件时,受制于对突发事件风险深度把控的不确定性,应急行政权的扩张往往延伸至公民基本权利的领域,使公民基本权利受到种种限制。这种扩张与限制的关系到底如何,依据宪法关于国家尊重和保障人权的规定,通过对应急行政视域下公民基本权利限制进行多角度的分析可知,在应急行政状态下限制公民基本权利具有合理性、正义性与合宪性。但应注重强化公民基本权利限制的着力点,在遵循比例原则、法律保留原则、明确性原则、司法审查原则等法定原则的基础上,充分发挥宪法解释在公民基本权利限制过程中的重要作用。
When responding to public emergencies such as the COVID-19,subject to the uncertainty of deep control over the risk of emergencies,the expansion of emergency administrative power often extends to the field of citizens’basic rights,which limits the citizens’basic rights.What is the relationship between this expansion and restriction?According to the Constitution’s provisions on the state’s respect and protection of human rights,through a multi-angle analysis of the restrictions on the basic rights of citizens under the perspective of emergency administration,we can see that it is reasonable,just and constitutional to limit the basic rights of citizens under the state of emergency administration.However,we should pay attention to strengthening the focus of citizens’basic rights restrictions,and on the basis of following the statutory principles of proportionality,legal reservation,clarity,and judicial review,give full play to the important role of constitutional interpretation in the process of limiting citizens’basic rights.
