摘要
人大及其常委会监督监察委员会是各级人大及其常委会为了保护国家和人民的根本利益,依照法律与党内法规对监察委员会进行监督的理念、制度与行为的总称。这一制度有助于丰富人民当家作主的表现形式,实现公职人员监督全覆盖后的有力监督,保障监察委员会权力依法运行。人大及其常委会监督监察委员会虽然实现了监督职能从试点规定到法制定型的转变,促进了人大监督制度不断完善,推进了我国反腐败形成压倒性态势,但也存在现行监督方式比较模糊、人大监督权与监察委员会监察权不完全协调、人大代表的专业监督能力有待提升等制约因素。这需要从完善人大监督监察委员会原则、释放人大对监察委员会监督的动力、区分监督相对人性质、丰富模式化监督行为、深化法律监督、强化民主课责、提高监督素质等方面加以健全。
The people's congress and its standing committee's oversight of the supervisory committee refers to the concept,system and act of the people's congresses and their standing committees at all levels to supervise the functions and powers of the supervisory commissions for protection of fundamental interests of the state and the people in accordance with laws and the Party's rules.It is helpful to enrich the forms of people's mastership,realize the powerful supervision after full coverage of national supervision,and to ensure the legitimacy of the operation of the commission's power.Although it has realized the transformation of the supervision function from the pilot regulation to the fixed legal system,promoted the continuous improvement of the supervision system of the people's congress,and boosted the overwhelming trend of anti-corruption in China,there are still some constraints like vagueness in some rules,incompatibility between the supervisory power of the people’s congress and that of the supervisory commission,and incompetency of oversight ability of the people's congress representatives.These need to be enhanced from the following aspects such as perfecting the principle of oversight,releasing impetus of oversight,distinguishing the nature of the oversight counterpart,enriching the oversight behavior mode,deepening the legal supervision,strengthening the democratic responsibilities in supervision,and improving the oversight ability.
