摘要
刑事错案是一种客观的司法事实,它既可能发生于侦查阶段,也可能发生于检察阶段,还可能发生审判阶段。不仅检察机关具有防止刑事错案发生的义务,而且公安机关和人民法院同样具有防止刑事错案发生的义务。公安机关、检察机关、人民法院应当是每一起被判决有罪的刑事错案的共同责任人,而检察机关则应为刑事错案的第一监督责任人。
Criminal misjudged cases are an objective judicial fact,which may occur in the investigation stage,in the prosecution stage,or even in the trial stage. Not only the procuratorial organs but also the public security organs and the people’s courts have the duty to prevent the occurrence of wrong criminal cases. The above three shall be jointly responsible for each misjudged criminal case,while the procuratorial organ shall be the first to supervise the misjudged criminal cases.
