摘要
规范性文件在新冠肺炎疫情防控期间的广泛适用,因应了风险社会治理的现实需求、填补和替代立法空白的需求,以及实现多元政策目标的需求。因行政应急的特殊性,导致规范性文件也存在行政应急权力易扩张、内容易突破合法合理限度、发文程序随意等诸多困境。为有效发挥规范性文件的治理效用,应当以合法合理行政原则作为基本遵循,以备案审查和清理环节等作为程序保障,同时以公共卫生应急法制体系的建构作为路径前瞻。
During the prevention and control of COVID-19,the government has realized the joint prevention and control from the top to the bottom through the formulation and issuance of normative documents.The wide application of normative documents in major public health events meets the practical needs of risk social governance,the needs of filling and replacing legislative gaps,and the needs of achieving multiple policy objectives.However,due to the particularity of administrative emergency,there are many difficulties in normative documents,such as the expansion of administrative emergency power,the breakthrough of legal and reasonable limits in content,and the random issuance of documents.In order to effectively play the governance effect of normative documents,we should follow the principle of legitimate and reasonable administration,and take the filing,review and clearing as the procedural guarantee.At the same time,we should take the construction of public health emergency legal system as the path to look forward,and build a path for the legal regulation of epidemic normative documents.
