摘要
目的采用比较单眼球摘除适用不同鉴定标准产生的差异,探讨规范统一的医疗损害伤残鉴定标准的价值。方法收集并分析最高人民法院“中国裁判文书网”公开数据中的25例“单眼球摘除(缺失)”裁判文书中医疗损害伤残程度鉴定结果。结果在医疗损害伤残程度鉴定中,因适用不同的伤残鉴定标准“单眼球摘除(缺失)”伤残等级结果存在显著的结果差异。结论从标准适用视角分析伤残等级结果差异的原因并提出解决思路,旨在规范统一医疗损害伤残鉴定标准。
Objective The differences between the different identification criteria applied by the single eyeball removal were compared,and the significance of the standardized medical damage identification standard was discussed.Methods Collect and analyze the results of the identification of medical damage and disability in 25“one-eye removal(missing)”judgment documents in the public data of the“Chinese Judgment Document Network”of the Supreme People's Court.Results In the identification of medical damage disability,there are significant differences in results due to the application of different disability identification criteria“single eyeball removal(missing)”disability grade results.Conclusion Analyze the causes of the differences in disability grade results from the perspective of standard application and propose solutions to the standardization of uniform medical impairment assessment standards.
