摘要
在作品标题的法律保护问题上,我国理论界和实务界存在权益认定与保护路径缺乏共识,法律调整与规范适用界限不清的基本问题。综合相关理论分析与域外经验,作品标题不宜作为《著作权法》的客体(作品)予以保护,而应视为经营者(作者)创作服务成果(作品)的商业标志,这一正当性主要来源于知识产权利益平衡机制及商业标志权益保护的理论基础。同时,囿于作品标题的特殊性和禁止市场混淆构成要件的法定性,应对经营者权益赋予的内容和条件施加必要的限制。
On the issue of legal protection of the work titles,in China’s theoretical and practical circles,there lacks of consensus on the identification of rights and the path of protection,as well as the basic issues of unclear boundaries between legal adjustment and norms.Combining relevant theoretical analysis and external experience,the title of the work should not be protected as the object(work)of the Copyright Law,but should be regarded as a commercial sign of the creative service of the operator(author).The legitimacy is mainly the intellectual property rights balance mechanism and the theoretical basis for the protection of the rights and interests of commercial signs.At the same time,due to the particularity of the title of the work and the statutory nature of the prohibition of market substitution,it should limit the necessary restrictions on the content and conditions caused by the rights and interests of the operator.
