“软法”与“硬法”在图书馆法治建设中的互动机制研究 被引量:2

摘要 "软法"的创立,体现了社会内生规范对于国家治理的正向作用,并成为图书馆法治建设中的新变量。在图书馆法治体系现代化进程中,"软法"基于其协商民主价值,可以发挥重要作用。通过对《中华人民共和国公共图书馆法》《公共图书馆服务规范》的文本分析,可以对"软法"与"硬法"在图书馆法治建设中的运行机制作出考察;而通过对"软法"与"硬法"进行的SWOT分析,可以发现两者存在"耦合"效应。在未来语境下,应该遵循公共文化领域立法的一般规律,实现"软法"与"硬法"在图书馆法治建设中的共生与共存,即促成"图书馆软法"与"图书馆硬法"之间的有机转化和良性共存。 The establishment of“soft law”reflects the positive effect of social endogenous norms on national governance,and becomes a new variable in the construction of library rule of law.In the process of modernization of library legal system,“soft law”can play an important role based on its consultative democratic value.Through the text analysis of Public Library Law of the People’s Republic of China and Public Library Service Standard,we can investigate the operation mechanism of“soft law”and“hard law”in the construction of library rule of law;and through the SWOT analysis of“soft law”and“hard law”,we can find that there is a“coupling”effect between them.In the future context,we should follow the general law of legislation in the field of public culture,and realize the“symbiosis”and“coexistence”of“soft law”and“hard law”in the construction of library rule of law,that is to promote the organic transformation between“library soft law”and“library hard law”and to realize the benign coexistence between“library soft law”and“library hard law”.
