摘要
最高人民法院司法解释肯定了养老金可以被强制执行,但实践中法院差异化的做法和被执行人的异议使得这一问题尚存有探讨的必要和空间。分析案例可以发现,正确厘定养老金的法律性质是回答养老金能否强制执行的前提和基础。对此,可以借助司法裁判的逻辑梳理与法理意蕴思辨,并以基本权利、财产权功能、财产权社会义务等理论定位养老金的社会保障权利属性,在此基础上就养老金强制执行问题做出充分的省思和正确的制度化安排。
The Supreme Court judicial interpretation confirms that the pension can be enforced,but the issue still needs to be explored because the inconsistent judgments of different courts and the objections the executors raised.By studying a certain number of cases,it can be found that whether a pension can be enforced requires a correct understanding of its legal nature.In this regard,we can clarify the nature of pensions with social security rights by sorting out the judicial judgment,thinking about the connotation of legal theory,and studying on the theories such as fundamental rights,property rights,and social obligations of property rights.Based on this,legal advice is put forward to solve problems related to the enforcement of pensions.
