摘要
由于地缘优势,中亚五国一直是陕西企业对外直接投资的重点地区。但该五国存在的法律风险与非法律风险对陕西企业在中亚地区的直接投资构成了巨大挑战。对此,政府应当与中亚五国加深政治互信、更新有关BIT、优化融资渠道和金融服务、完善海外投资保险机制、建立完善的信息服务平台、加快培养专业人才;企业要处理好与当地人民和政府的关系、遵守并利用东道国法律、建立风险评估、预防以及减损机制、善于利用国内及国际法律手段维护正当权益。
Due to its geographical advantages,central Asia has always been the key area of foreign direct investment for Shannxi enterprises.However,the legal and non-legal risks existing in Central Asian countries pose a huge challenge to Shannxi enterprises'direct investment in the region.In this regard,the government should deepen political mutual trust with central Asian countries,update relevant BIT,optimize financing channels and financial services,improve overseas investment insurance mechanism,establish perfect information service platform,and accelerate the cultivation of professional talents.Enterprises should manage their relations with local people and governments,abide by and use host country laws,establish risk assessment,prevention and derogation mechanisms,and be good at using domestic and international legal means to safeguard their legitimate rights and interests.
