摘要
近年来,随着高等教育市场化改革的推进,大学生作为消费者的身份得到普遍认同,英国政府和社会各界高度重视大学生消费者权益保护问题。英国大学生消费者权益保护的适用法律包括《消费者权益法》《消费者合同(信息、取消和附加费)条例》《消费者免受不公平交易条例》,规定了高校在信息提供、条款与条件以及投诉处理流程等重点领域应履行的义务,从政府监管机构、大学生申诉协调机构和高等教育机构等三个层面展现大学生消费者权益保护机制的图景。英国大学生消费者权益保护制度与实践能为我国大学生权益保护的立法实践、重点领域与机制构建提供有益的启示。
In recent years, with the advancement of the market-oriented reform of higher education, the identity of university students as consumers has been widely recognized. The British government and all sectors of the society attach great importance to the protection of university students’ consumers rights. Its applicable laws include Consumer Rights Act, Consumer Contracts(Information, Cancellation and Additional Charges) Regulations and Consumer Protection from Unfair Trading Regulations. Universities should fulfill their obligations in key areas such as information provision, terms and conditions, and complaint handling procedures. The protection mechanism covers three levels: government regulatory body, student complaint coordination body and higher education institution. The system and practice of consumer rights protection for university students in the UK can provide useful enlightenment for the legislative practice, key areas and mechanism construction of college student rights protection in China.
