摘要
随着2019年12月1日新《药品管理法》的实施,刑法中销售假药罪的相关认定随之发生改变。因此,从销售假药罪及其相关罪名长久以来的争议为背景,探讨新修订法案的合理性,明确药品行政违法和刑事违法的界限,十分必要。新《药品管理法》修订后仍存在诸多问题,对这些问题后续的立法和实践,要尽快加以改进和完善。
With the implementation of the New Drug Administration Law on December 1,2019,the relevant determination of the crime of selling fake medicine in the criminal law has changed accordingly.Therefore,it is necessary to discuss the rationality of the new revised law and clarify the boundary between the administrative and criminal violations of drugs against the background of the long-standing disputes over the crime of selling fake medicine and related crimes.There are still many problems after the revision of the new drug administration law.The follow-up legislation and practice of these problems should be improved and perfected as soon as possible.
