摘要
目前我国食用菌的生产和经营存在行业管理不规范,相关法律不健全、投资不足、产业化程度低、经营方式落后等问题,为解决以上问题,从法律角度研究了食用菌生产与经营的监管模式。食用菌生产与经营企业应持有许可证书,且要明确证书申请流程规范。通过明确使用目的、使用批准、使用担保以及使用监督四个方面,加强食用菌的知识产权的保护,避免食用菌菌种滥用。为了切实解决食用菌管理问题,需要完善相关法律法规,不断提升食用菌行业的法律服务水平,促进食用菌生产与经营的良性发展。
At present,the production and operation of edible fungi in China have problems such as non-standard industry management,imperfect relevant laws,insufficient investment,low industrialization degree and backward operation mode.Edible fungi production and business enterprises should hold a license,and to clarify the application process specifications.By clarifying the purpose of use,approval,guarantee and supervision of use,the protection of intellectual property rights of edible fungi should be strengthened to avoid the abuse of edible fungi.In order to effectively solve the problem of edible fungi management,it is necessary to improve relevant laws and regulations,constantly improve the legal service level of edible fungi industry,and promote the benign development of edible fungi production and management.
