摘要
在动物检疫工作中推行行政执法公示、执法全过程记录、重大执法决定法制审核三项制度,有助于积极推进规范公正文明执法,引导动物卫生监管部门严格依法行政。本文聚焦动物检疫执法的依据、过程、结果等关键环节,阐述了行政执法三项制度的实施内容:依法向群众公示实施动物检疫的法律依据、实施程序、检疫结果,全面记录实施动物检疫工作过程,依法依规科学公正作出检疫结论,进一步科学规范动物检疫行为。剖析了我国现行兽医制度、动物检疫制度、法律法规现存问题。提示在人员保障方面,应进一步厘清官方兽医行政管理、综合执法、技术支撑等职能,加强考核备案管理;技术保障方面,应加大动物检疫记录的设备保障投入,建立基于疫病监测和动物卫生风险评估的产地检疫机制;法律制度保障方面,应适时调整有关法律条款,为落实兽医体制改革政策,科学规范检疫行为及高效便捷为民服务提供法制保障。
The systems of publicity,records and legal audit against major decisions related to administrative law enforcement("three systems")that are implemented during animal quarantine contribute to the standardization,fairness and civilization of law enforcement,and to ensuring legal administration by animal health supervision departments.Focusing on the key links such as the basis,process and results of law enforcement for animal quarantine,the"three systems"was stated in this paper,the legal basis,implementation procedures and quarantine results of animal quarantine were made public,and such quarantine was scientifically concluded in accordance with relevant laws and regulations for the purpose of further standardizing animal quarantine.In addition,the existing problems in current veterinary system,animal quarantine system,laws and regulations in China were analyzed to put forward some suggestions,specifically,for human resource,the responsibilities of official veterinarians,such as administrative management,comprehensive law enforcement,technical support,should be further clarified;for technical supports,the equipment for recording animal quarantine should be ensured and the origin quarantine system based on disease surveillance and animal health risk assessment should be established;and for legislation,relevant laws and provisions should be amended as appropriate to provide legal guarantee for the reform of veterinary system,standardization of quarantine behaviors and efficient services for the public.
