摘要
现行"一地两权"的宅基地制度已经不适应我国当前农村经济发展的需要,宅基地制度的现实困境主要表现在宅基地空置严重与隐形市场非法流转繁盛的矛盾。基于此,宅基地"三权分置"应运而生,宅基地"三权分置"不仅符合现代物权法关于"重用益、轻所有"的发展需要,还可以助推农村经济的发展,促进土地资源的合理配置,对于缓和城乡二元经济结构也有重要作用。宅基地"三权分置"要继承和发展"两权分离"下宅基地使用权的法律特征,在完善宅基地使用权的法律构造的基础上强化宅基地使用权的物权权能,并规范宅基地制度相关配套的立法和法律解释,使之成为《民法典》的重要组成部分。
The current homestead system of "one land and two rights" has not been adapted to the needs of the current rural economic development in China,and the realistic predicament of the homestead system is mainly manifested in the contradiction between the serious vacancy of homestead and the flourishing of illegal circulation in the invisible market.Based on this,homestead "three rights Separation" came into being,homestead "three rights Separation" not only in line with the modern property law on the "emphasis on benefits than ownership" development needs,but also can promote the development of rural economy,promote the rational allocation of land resources,and also play an important role in easing the dual economic structure of urban and rural areas.The "Three Rights Separation" of Homestead should inherit and develop the legal features of the right to use the homestead under "Separation of Two Rights",strengthen the real right capacity of the right to use the homestead on the basis of perfecting the legal construction of the right to use the homestead,and standardize the relevant legislation and legal interpretation of the homestead system,so that it becomes an important part of the Civil Code.
