摘要
17版FIDIC合同的争端解决条款由DAAB构成,DAAB是在DAB的基础上发展而来。基于17版FIDIC合同相关条款,分析DAAB的成员构成、责权划分、运行程序及法律效力等方面的内容和相关问题,以期能够促进该条款在实际中的运用及其作用的发挥,降低工程争端解决的时间和经济成本。
The content of dispute problem settlement clauses under 2017 FIDIC contract is made of DAAB.DAAB is developed on the basis of DAB.Based on the relevant provisions of 2017 FIDIC contract,this paper analyzes the content and related issues of DAAB’s membership composition,responsibility division,operation procedure and legal effect,in order to promote the application and function of the provisions in practice and reduce the time and economic cost of project dispute settlement.
