摘要
面对农村的现实需求和我国现行法律的限制,“三权分置”政策的提出为宅基地使用权流转制度变革提供了契机。“三权分置”背景下宅基地使用权流转制度变革的基础在于厘清“三权”关系,核心在于宅基地使用权“还权赋能”。在此基础上,变革的具体方向应当包括:允许宅基地使用权自由、单独流转;落实宅基地资格权,延续宅基地社会福利保障功能;构建宅基地使用权费用支付机制、流转登记制度,扩大宅基地使用范围;完善农村社会福利保障体系。
Faced with of the needs of the current situation in rural areas and the limitations of the current laws in China, the policy of "separation of three rights" provides an opportunity for the reform of transfer system of the right to use homestead. Under the background of "separation of three rights", the basis of the reform of transfer system of the right to use homestead lies in the clarification of the relationship between the three rights, and the core lies in the return and empowerment of the right to use homestead. On this basis, the specific direction of the reform should include allowing the free and independent transfer of the right to use homestead, implementing the guarantee attribute of the right to use homestead, purifying the property attribute of the right to use homestead, establishing the delivery of the fees for the use of homestead and the announcement system of the right to use homestead, expanding the scope of the use of homestead and improving the system of rural welfare security.
