论中央和经济特区关系的法治化

On the Legalization of the Relationship Between the Central Government and SEZs

摘要 设立经济特区并授予其特别立法权是我国的一次重大政治体制改革试验和法治试验。历史地看,中央与经济特区关系演变的过程也是中央和经济特区关系的法治化过程,我国改革开放的需要和经济特区发展需要的相结合催生了独特的中央和经济特区关系。法律上看,改革开放政策、中央和地方积极性的发挥为中央和经济特区关系调整提供了法治化基础,全国人大及其常委会的授权决定和《立法法》中授权立法的规定,为中央和经济特区关系提供了法治化的路径。实践上看,中央和经济特区关系法治化取得了巨大社会效果,蕴藏着巨大的制度优势。因此,经济特区不仅仅是制度创新、法治先行区的成功样本,更是中央和地方关系法治化的样本。 The establishment of special economic zones(SEZs)with special legislative power is a major experiment of political reform and legal system in China.Historically,the evolution of the relationship between the central government and SEZs is also a process of its legalization.This unique relationship was evoked by the demands for reform and opening up as well as the development of SEZs jointly.Legally,the reform and opening up policies and the initiatives of both the central and local governments have provided a legal ground for the adjustment of the relationship;and the empowerment by the National People’s Congress(NPC)and its standing committee plus the empowerment legislation provisions stipulated in The Legislation Law has provided approaches for the legislation of this relationship.In practice,the legalization of the relationship has achieved remarkable social achievements owing to its great institutional advantages.Therefore,SEZs are not only successful samples of system innovation and pilot zones under the rule of law,but also examples of the legalization of central-local relations.
