我国公平竞争审查投诉机制优化研究

摘要 我国从2016年7月开始实施公平竞争审查制度。投诉机制作为公平审查竞争制度长效的事后公众监督机制,有利于在政府与公众之间构建直通车,保障公平竞争审查制度的有效实施,规范政府的行政行为。但投诉机制的现状不尽如人意,其根源还在于投诉机制的构建不完善。借鉴澳大利亚竞争中立投诉机制,同时参考我国的其他投诉救济程序,构建符合我国实际需要的公平竞争审查投诉机制,以期更好地落实公平竞争审查制度,建立统一开放、竞争有序的市场体系。 The Fair Competition Review System has been adopted since July 2016. Public complaint mechanism, as an afterthe-fact public supervision mechanism of Fair Competition Review System, helps build a through train between the government and the public, ensures the effective implementation of Fair Competition Review System and standardizes the government’s administrative behavior. However, the complaint mechanism currently is not doing well, and its problem lies in the imperfect construction of the complaint mechanism. Referring to Australia’s Competition Neutral Complaint Mechanism and other complaint relief procedures in our country, public supervision mechanism that meets the actual needs of our country is necessary for the improvement of the public complaint mechanism and the establishment of a unified, open and orderly market system.
