浅析氯喹的专利申请情况和生产中可能遇到的专利风险

摘要 氯喹是一种主要用于控制疟疾症状的药物,还具有抗炎、抑制免疫、抗感染等作用。在2019年新型冠状病毒肺炎暴发以来,氯喹对治疗新型冠状病毒肺炎的有效程度使得氯喹再次映入公众的眼帘,故而作者对氯喹的专利申请情况进行分析,以助研发人员更为快速获取有效药物,使企业在制备氯喹产品时规避侵权风险。老药氯喹的研发较为成熟,各年份的专利并无大幅涨落;近年来有关氯喹的专利申请主要集中在其抗肿瘤、抗疟疾等方面的药物联用;关于氯喹的制药用途专利是此次新型冠状病毒肺炎防治中的关注重点,文中对部分重点专利进行了介绍;涉及氯喹的核心专利(如化合物或制备方法)早已到期,仅生产或制备氯喹原料药不会存在专利侵权风险,在此次新型冠状病毒肺炎的防治中,对于医药企业来说,需重点关注氯喹药物剂型的相关专利,避免在药物生产过程中侵犯他人专利权。 Chloroquine is a drug mainly used to control the symptoms of malaria.It also has antiinflammatory,immune-suppressing and anti-infective effects.Since the outbreak of COVID-19,the effectiveness of chloroquine in the treatment of COVID-19 had brought chloroquine to the public again.The author therefore analyzed the patent application of chloroquine to help researchers to obtain effective drugs more quickly,and to enable enterprises to avoid the risk of infringement when preparing chloroquine products.While the research and development of the old drug chloroquine was relatively mature,the number of patents in various years had not fluctuated significantly.In recent years,patent applications of chloroquine mainly focused on its combination of drugs in anti-tumor and anti-malaria.Because the pharmaceutical use of chloroquine was the key point of attention in the prevention and treatment of COVID-19,some key patents about it were introduced in this article.Core patents(such as compounds or preparation methods)related to chloroquine had already expired,therefore there was no risk of patent infringement for the production or preparation of chloroquine API.In the prevention and treatment of COVID-19,for pharmaceutical companies,in order to avoid infringing others'patent rights in the drug production process,it is necessary to focus on the relevant patents of chloroquine about drug formulations.
