摘要
传统监禁刑执行方式存在诸多弊端,既不利于罪犯矫正,也不符合目前世界“刑罚轻缓化、人性化、民主化”的潮流,因此需要我们探索新的刑罚执行方法。当前,世界上主要的刑罚执行模式有监禁刑(狱内行刑社会化)、半监禁刑和非监禁刑,其中半监禁刑和非监禁刑的适用率很高。从国外已经取得实践成功经验的国家的刑罚执行方式入手进行研究、思考,进而诊断我国刑罚执行方式的问题所在,可以为我国监禁刑执行社会化提供相应的解决方案。
Due to many disadvantages of the traditional method of imprisonment,it is not conducive to the correction of criminals,which is not in line with the current trend of“mitigation of punishment,humanization and democratization”in the world.Therefore,we need to explore new methods of punishment enforcement.At present,the main modes of punishment enforcement in the world are:imprisonment(socialization of executions in prison),semi-custodial punishment and non-custodial punishment,of which the application rate of semi-custodial and non-custodial punishment is very high.Studying and thinking about the ways of punishment enforcement in some foreign countries that are more successful in practice and diagnosing the problems of the way of punishment enforcement in China can provide corresponding solutions for the socialization of imprisonment in China.
