摘要
村庄规划的相关法规包括城乡规划行业内的法规体系和城乡规划行业以外的法规体系两部分。这些法规所确立的城乡规划管理制度、村民自治制度、土地产权制度,在具体的村庄规划管理与实施过程中暴露出许多问题:一是村庄规划管理权与村民自治权的相互制约,二是自上而下的行政决策与自下而上的民主决策的制度冲突,三是农村集体土地的收益权和使用管理权分离。文章系统梳理村庄规划相关的法规和制度,从法规视角剖析目前国内村庄规划中出现的管理与实施问题产生的原因,并基于现有的法律环境提出规划应对策略。
The legal basis for rural planning includes two parts:the legal system in the field of urban and rural planning and the legal system outside the field of urban and rural planning.The systems established by these regulations involve urban and rural planning management system,villager autonomy system,urban land state ownership system,rural land collective ownership system.There are problems among these systems in the process of rural planning management and implementation.The article systematically sorted out the legal basis for rural planning,summarized the institutional issues of rural planning management and implementation,and put forward coping strategies.
