摘要
近年来,校园欺凌案件在我国频频发生,引发社会各界广泛关注和讨论。但因缺乏针对反校园欺凌的专门立法,相关案件常常通过学校进行和解,导致许多欺凌者并未受到应有的惩罚。此外,由于家长、学校对于欺凌事件缺乏重视,学生遭受欺凌后不敢告诉父母、老师,往往造成严重后果后才被发现。为减少乃至遏止校园欺凌,本文将基于我国现状,通过借鉴已颁行相关立法的美国、日本、瑞士的法律内容,对我国《反校园欺凌法》提出立法构想。
In recent years,school bullying cases occur frequently in China,which has aroused wide concern and discussion.But in the absence of specific anti-bullying legislation,cases are often settled through schools,leaving many bullies unpunished.In addition,due to the lack of attention paid to bullying by parents and schools,students dare not tell their parents and teachers after being bullied,which often causes serious consequences before they are discovered.In order to reduce and even curb school bullying,this paper will propose the legislative concept of China's anti-school bullying law based on the current situation of our country and by referring to the laws of the United States,Japan and Switzerland that have enacted relevant legislation.
