摘要
不动产关乎到我国社会主义市场经济的安全稳定,关乎到千家万户的切身利益。当前,仍存在一房多卖等损害权利人及利害关系人合法权益的行为。本文将针对不动产发生物权转移和设立债权时的若干风险点进行分析研究,探讨在现行的不动产登记制度设计前提下,如何充分利用预告登记,合理设置业务环节,设计与相关部门的业务协同机制,将预告登记应用于包括房屋预售在内的不动产登记各种业务类型,以有效防范一房多卖等问题,保护权利人的合法财产权,保障社会主义市场经济秩序的安全稳定。
The safety of the real estate is related to the safety and stability of our socialist market economy and the vital interests of thousands of families.At present,there still exists a room sells more phenomenon,which causes damage to the legitimate rights.This article will focus on and analysis the risk points during the real estate property rights transferring and the establishment of creditor’s rights,to explore under the premise that the current real estate registration system design,how to make full use of advance-notice registration,setting up reasonable business links,and design the synergy mechanism of related departments,advance-notice registration shall be applied to various types of real estate registration including house pre-sale,effectively preventing the problem such as a room sells more phenomenon,protecting obligee’s legitimate property rights,guaranteeing the security and stability of the socialist market economic order.
