摘要
近年来校园霸凌事件频发,随着有关媒体的曝光,屡屡引发社会舆论和新闻媒体的关注。校园霸凌行为对未成年人的生理和心理都造成了不可逆的影响,同时也挑战着社会的道德底线。目前我国《未成年保护法》对未成年人责任年龄的限制,导致防治校园霸凌问题在法律依据上力有不逮。笔者拟从我国校园霸凌现象的现状及特征分析入手,爬梳国外反校园霸凌法立法上的经验和启示,进一步探讨适合我国校园霸凌法律规制的完善路径。
With the frequent school bullying in recent years and the media exposure,it has aroused public opinion and the attention of the news media.School bullying has made irreversible effects on the young physically and mentally,and it is challenging the moral bottom line of society.Limitation of age of liability in The Law of the Protection of Juveniles leads to being incompetent about school bullying in laws.The author analyzes the status quo and characteristics of school bullying in China,sorts out experience and revelation school bullying in foreign countries,to discuss the adaptive approaches of legal regulations on school bullying.
