摘要
自由贸易试验区外商投资负面清单制度是我国自贸区内外资管理的重要制度,对我国解放市场,扩大开发,发展外向型经济起到重要的促进作用。我国自贸区负面清单制度已实行6年,经历5次修改,现行负面清单的内容更精简、开放程度更高,体现了独特的价值。由于我国负面清单制度推行时间较短,不可避免地在内容、法律法规、政府监管方面存在问题。负面清单制度的完善应该从建立健全外商投资法律体系、优化政府行政管理、完善负面清单的内容三方面入手,从而进一步提升我国经济管理水平,充分发挥市场在资源配置中的决定性作用,深化改革开放。
The negative list system of foreign investment in the pilot free trade zone is an important system for foreign investment management in China’s free trade zone,which plays an important role in liberating the market,expanding development and developing the outward-oriented model.The current negative list in China is more concise and open,which reflects its unique value.However,problems inevitably exist in terms of content,laws and regulations,and government supervision due to the short implementation time of the negative list system in China.The improvement of the negative list system should start from the establishment of a sound legal system for foreign investment,optimization of government administration,and the improvement of the contents of the negative list,so as to further improve China’s economic management level,give full play to the decisive role of the market in resource allocation,and deepen reform and opening up.
