摘要
经济新业态带来传统劳务派遣用工方式的变化,引发“关联”劳务派遣用工问题。“关联派遣”具有劳务派遣的一般特性,亦表现出多边供需结构关系特征,个别劳动者需要面对复数用工单位企业。应依赖法际整合路径规制“关联派遣”用工,通过对关联关系或关联企业本质属性的认识探究具体规则。原则上立法对“关联派遣”应保持谨慎态度,并需结合“关联派遣”用工方式探究用人单位责任和用工单位责任的具体实现途径,合理规范此类劳务派遣用工行为。
The New Business Model brings the change of the traditional labor dispatching,and causes the problem of“related”labor dispatching.“The Related dispatching”has the general characteristics of labor dispatching and also shows the characteristics of the structure of multilateral supply and demand.We should rely on the path of inter-integration to regulate the employment of“the Related dispatching”,and explore specific rules through the understanding of the essential attributes of relationship or the associated enterprises.In principle,the legislation should keep a cautious attitude towards the“the Related dispatching”and establish the joint liability system of the staffing firms and the accepting unit,to regulate such labor dispatching behaviors reasonably.
