摘要
社会组织的“宽进”政策使其得到了快速的发展,保障其规范性发展也成为了当前国家的重要问题。国家目前处于转型时期,传统的政府治理手段日渐式微,而以信用为核心的社会治理方式正日渐兴起。因此,为了进一步加强对社会组织的管理,信用监管手段成为了当前社会治理的创新方式。在社会组织出现不履行义务或其他相关法律规定的情形下,由有关监管部门将其列入活动异常名录,从而督促相关主体义务的履行,优化政府监管,推动社会组织向良性方向发展。但这一行为由于设立位阶较低,缺乏基础法律的支撑,行为性质还不够明确,应对列入活动异常名录行为的法律性质、法律效力、法律救济进行有效的制度设计,以充分发挥以信用为核心的制度功能。
The social organization's"lenient advancement"policy has enabled it to develop rapidly,and ensuring its normative development has become an important issue for the country.The country is currently in a transition period,traditional government governance methods are gradually diminishing,and credit-central social governance methods are gradually emerging.Therefore,in order to further strengthen the management of social organizations,credit supervision has become an innovative way of social governance.In the case of non-performance of social organizations or other relevant legal requirements,relevant regulatory authorities will include them in the abnormal activity list,thereby urging the performance of relevant subject obligations,optimizing government supervision,and promoting the development of social organizations in a benign direction.However,due to the low level of establishment and the lack of basic legal support,the nature of the behavior is not clear enough.The legal nature,legal effect,and legal relief of the behavior included in the abnormal list of activities should be effectively designed in order to give full play to credit as the core institutional function.
