摘要
区域大气污染联合防治法律机制既应充分发挥政府主导作用,也离不开市场机制、社会机制的调节作用;既要强化中央政府调控与引导,也要重视激发地方政府的能动性。因此,区域大气污染联合防治法律机制应以合作规制理念为指导,破除政府管制等单向思维,构建有利于充分发挥政府、市场、社会机制调节作用,调动中央和地方两个积极性的法律制度。
The legal mechanism for the joint prevention and control of regional air pollution should not only give full play to the leading role of the government,but also depend on the regulating role of market mechanism and social mechanism.We should not only strengthen the control and guidance of the central government,but also attach importance to stimulating the initiative of local governments.Therefore,the legal mechanism for the joint prevention and control of regional air pollution should be guided by the concept of cooperative regulation,break away from one-way thinking such as government regulation,and construct a legal system that is conducive to giving full play to the regulatory role of government,market and social mechanisms and mobilizing the enthusiasm of the central and local governments.
