摘要
《刑案汇览》收录嘉道年间(1796-1850年)的私盐案件,反映了清政府在食盐缉私活动中存在较为严重的监守自盗现象,同时也反映了商雇缉私人员的法律地位要比官设缉私人员低。清政府将官设缉私人员与商雇缉私人员置于不同地位的做法,意图规范对商雇缉私人员的管理,却产生了较为严重的负面效应,影响了食盐缉私的效果。
The illegal salt cases during 1796-1850(known as Jiaqing and Daoguang Periods)in the Qing Dynasty recorded in the Conspectus of Penal Cases reflect the popular phenomenon that Custodian appointed by the Qing Central government turned thief in the anti-smuggling activities.It also reflects that the legal status of privately-owned anti-smuggling members is lower than that of the officially-appointed anti-smuggling members.The disparity between privately-owned anti-smuggling members and the officially-appointed anti-smuggling members might regularize the management of anti-smuggling personnel hired by businessmen.At the same time,it has some negative effects over anti-smuggling activities.
