摘要
社区矫正检察监督是一项重要检察工作,具有多元目的,呈现出事后性、特定性与广泛性等特征。当前社区服刑人员具有一定规模且成分复杂,检察监督面临的相关问题是缺失专门化检察监督机构与人员;检察监督机制不健全;检察监督标准不统一;检察监督浮于形式;检察监督手段刚性不足等。相关应对策略包括:以内设机构改革、员额制检察官改革、书记员招录改革为契机加强检察机构及队伍建设;通过建立预警监督机制、人民监督员机制以及综合治理考评机制等方面健全检察监督机制;拓宽线索渠道加强司法办案;着力推进智慧检察与信息化建设;将公益诉讼纳入社区矫正检察监督;加强立法规范检察监督工作标准。
The procuratorial supervision of community correction is an important procuratorial work,which has multiple purposes and characteristics of after feature,specificity and universality.At present,the community prisoners have a certain scale and complicated composition,the related problems of procuratorial supervision include:Firstly,the lack of specialized procuratorial supervision institutions and personnel.Secondly,the imperfection of procuratorial supervision mechanism.Thirdly,the disunity of procuratorial supervision standards.Fourthly,the superficial practice of procuratorial supervision.Fifthly,the insufficient rigidity of procuratorial supervision methods and so on.The relevant countermeasures include:Firstly,take the reformation of internal institutions,prosecutor system for specified number of personnel,recruiting clerks as an opportunity to strengthen the construction of procuratorial organs and teams.Secondly,through the establishment of early warning supervision mechanism,people’s supervisor mechanism and comprehensive management and evaluation mechanism to improve the procuratorial supervision mechanism.Thirdly,broaden the clue channels and strengthen judicial handling of cases.Fourthly,focus on promoting the intelligent procuratorial works and informatization construction.Fifthly,bring the public interest litigation into the procuratorial supervision of community correction.sixthly,strengthening the legislation and standardizing the work of procuratorial supervision.
