摘要
票据利益返还请求权作为票据法上的救济性权利,用以维护票据流通效率、安全与保护持票人利益。基于该制度理论定位不符合一般民法规则,实践运用中又产生众多问题,因此有观点建议废除该制度。票据利益返还请求权作为具有救济性色彩的特别权利,基于票据的短时效主义、票据保全手续的繁琐、票据金额的庞大,该权利实有存在的必要。对于该权利制度的再构建,应重点关注权利行使的情形、权利救济的范围等,把握救济的限度,避免权利规则被突破及滥用。
The right of Claim for Return of Interest is used to balance the efficiency of circulation of bills and the interests of the interests of the holder.Based on the theoretical positioning of the system is not in line with the general rules of civil law,and there are many problems in practice,so there are views and suggestions to abolish the system.As a special right with the feature of relief,the right of claim for restitution of the benefit of a note is necessary due to the short-term validity of bills,the tedious procedures for preserving the right and the substantial amount of bills.With respect to the re construction of the right system,special attention shall be paid to the circumstances under which the rights are exercised and the scope of remedy so as to grasp the limit of remedy and avoid the violation and abuse of rules of rights.
