摘要
大数据时代未成年人刑事信息的高速传播及记忆永恒不仅不利于未成年人回归和成长,还有可能侵犯未成年人的隐私权甚至生命权。然而,我国现有法律法规不足以应对这一困境。未成年人及其监护人要求数据控制者删除未成年人刑事信息的被遗忘权高度契合了未成年人最大利益原则并有效填补了制度漏洞,不过该权利也存在理论层面的不完备、对网络服务商等义务主体要求过高、有效责任承担机制缺失等缺陷。实践中可采用双重基准理论对权利价值进行预判,再辅以考究权利行使是否正当合理、是否尊重知情权、是否均衡保护等三元基准范式的指引下,从单列立法保护、明确第三方数据监管、厘清权利边界、优化权利救济形式等四维路径来构建我国未成年人刑事信息被遗忘权体系,以缓解大数据时代带给未成年人的新挑战。
In the era of big data, the high-speed transmission and memory of juvenile criminal information is not only harmful to the return and growth of minors, but also may violate the privacy right and the right to life of minors. However, the existing laws and regulations are not enough to deal with this dilemma. The oblivion right that minors and their guardians require data controllers to delete criminal information of minors highly conforms to the principle of the best interests of minors and effectively fills in the loopholes of the system, which is worth learning. However, there are some defects in this right, such as the incompleteness of theory, the high demand for the network service providers and the lack of effective liability mechanism. In practice, we can use the double benchmark theory to predict the value of rights, and then under the guidance of three benchmark paradigms, such as whether the exercise of rights is reasonable, whether the right to know is respected, whether the protection is balanced, etc., to construct the criminal information quilt of minors in China from the four-dimensional path of single legislative protection, clear third-party data supervision, clear right and interest boundary, and optimize the form of right relief Forgetting right system, to alleviate the new challenges brought by the age of big data to minors.
