摘要
利用信息网络实施恶势力犯罪与一般情形下的恶势力犯罪既有共同之处,也有不同之点,在具体案件的认定上应全面、系统的考察。对恶势力团伙纠集者进行认定时要把握纠集的具体情形,分而论之;对于区域影响应从网络空间的领域进行评析认定;对进行恶势力犯罪活动时所采用的“软暴力”手段要严格参照相关法律及司法解释进行分析;对于社会影响的判断,应结合网络空间和现实生活线上、线下两个维度综合考察,以实现司法实务中对具体案件的准确认定,罚当其罪。
There are both similarities and differences between the evil force crimes by means of information network and the common evil force crimes.For the affirmation of specific cases,the investigation should be comprehensive and systematic.It ought to take specific details into account for the affirmation of organizers of evil force gangs and affirm the region impact from the aspect of network space.It is a must to make an analysis of the"soft violence"means in the activities of evil force crimes according to relevant laws and judicial interpretation.As for the judgment of social impact,it ought to make investigations from the two dimensions of network space and real life so as to realize the accurate affirmation of specific cases in judicial affairs and accordingly punish the criminals.
