摘要
印度版权法规定了适用范围宽泛的图书馆版权例外制度。其中,印度图书馆复制、出借与保存的版权例外,使图书馆能够充分有效地使用版权作品,服务于公众利益。为了保障残疾人利用图书馆获取信息和知识的权利及充分发掘孤儿作品的价值,印度还赋予图书馆促进残疾人获取作品及孤儿作品开发的版权例外。同为发展中国家,我国应借鉴印度的有益经验,进一步明确并扩大我国《著作权法》中图书馆版权例外的适用范围。
The Indian Copyright Act provides for a wide range of library exceptions. The library copying, lending and preservation exceptions enable the library to use copyrighted works fully and effectively to serve the public interest. In order to guarantee the right of the disabled to access information and knowledge and to enable the public to access orphan works through libraries, India also stipulates library exceptions to promote the use by the disabled and the use of orphan works. As a developing country, China should learn from the experience of India, and further clarify and expand the scope of application of library copyright exceptions in our copyright law.
